Contest Rules and Regulations

THESE RULES AND REGULATIONS CONSTITUTE THE TERMS OF SERVICE AND ARE A LEGAL AND BINDING AGREEMENT BETWEEN YOU AND THE TORONTO CHAPTER OF THE SOCIETY FOR CONSERVATION BIOLOGY (hereafter “SCB-TO”) governing your use of (the "Service"), which includes but is not limited the Nature & Wildlife Photography Contest (the “Contest). “SCB-TO” includes its parent organization, affiliates, contractors, volunteers, agents, assigns and executors.

  1. Eligibility: The Contest is ONLY open to legal residents of Ontario who reside near the Greater Toronto Area and have reached the age of majority ("Participants"), except SCB-TO Executive Board members, Contest organizing committee members, and Contest judges.
  2. Contest period: Participants may submit photos ("Entries") from 12:00 a.m., Eastern Time, April 14, 2014 to 11:59 p.m., Eastern Time, May 14, 2014. Any Entry received outside of this period will be automatically disqualified. SCB-TO reserves the right to change any deadline(s) as the result of causes beyond its immediate control.
  3. To enter: Participants must register, upload a digital copy of their photographs to and provide a high quality (300 dpi) 8x10" or 8x12" hard copy display print within the contest period. SCB-TO highly recommends Participants order, at their own expense, display prints from Downtown Camera ( using the promotional pricing provided for the Contest. Display prints ordered through Downtown Camera are picked up weekly by SCB-TO and do not need to be mailed to SCB-TO. Display prints obtained from any other photographic printing establishments may be mailed to: Society for Conservation Biology - Toronto Chapter, c/o Dept. of Ecology and Evolutionary Biology, University of Toronto, Room 417, 25 Harbord Street, Toronto, Ontario, M5S 3G5. No other attempted method of entry will be accepted or acknowledged. Automated entries are prohibited, and any use of such automated devices will cause disqualification. All entrants must have a valid e-mail address to enter.
  4. Contest entry restrictions: Limit five (5) photograph submissions per person. Entries indicating the same contact information (name, email, telephone, etc.) will be considered, for the purpose of the Contest to belong to the same Participant and are therefore subject to the above restriction. Excess Entries SCB-TO reasonably believes belong to the same Participant will be considered invalid.
    1. All Entries should be related to the appreciation of nature and wildlife and in line with SCB-TO’s mission of advancing the science and practice of conserving the Earth's biological diversity. Photo(s), related content and comments must not contain or encourage any illegal acts, nor contain any obscene, defamatory, threatening, pornographic, harassing, hateful, racially or ethnically offensive content.
    2. Photo(s) must be true to life, only adjustments to the overall image which preserve the integrity of the photograph are permitted.
  5. By signing up or submitting an Entry to the Contest you:
    1. Consent to the collection and technical processing of registration data, including, but not limited to, personal information and photo(s) details. You agree to provide true, accurate and current information and accept sole responsibility for maintaining the confidentiality of your password and username;
    2. Grant SCB-TO permission to use your photo(s) for any purpose including, but not limited to, promotional material, fundraising, publications, websites and displays, without further review or compensation to the you or any individuals in the photo(s);
    3. Certify that you own all copyrights to the photo(s) you submit. You represent and warrant that the photo(s) have not been copied in whole or in part from any other work, do not violate or infringe on the rights of any other person or entity, and are together with the copyright and moral rights therein, the sole and exclusive property of the Participant. You accept sole responsibility for all costs associated with the remedy of copyright infringement including but not limited to, awards, damages or legal fees;
    4. Certify that any person(s) in the photo(s) have provided their consent in allowing their image or likeness to the entered in the Contest, and publicly displayed on the Contest website. Failure to obtain such consent will disqualify the Entry;
    5. Grant SCB-TO permission to use and authorize others to use your name in association with your Entry for identification, editorially, or for publicity. You agree to allow the photo(s) to be publicly posted on the Contest website and for SCB-TO to enable functionally which allows users to comment on and vote for submitted photo(s). You also agree to allow other users of the Service to repost photo(s) on third party sites and social media services, including, but not limited to Facebook and Twitter. SCB-TO is not responsible for the integrity or content of material posted by users on such platforms.
  6. SCB-TO reserves the right disqualify any Participants or Entry, and remove any user, photo(s), content, or comments from the Service if SCB-TO reasonably believes they do not meet the requirements of the rules and regulations, infringe on the claimed copyright of the owner, contain inappropriate content, contain any offensive and/or illegal acts, or infringe on the ability of others to enjoy the Service.
  7. Conduct on the Service: SCB-TO neither endorses nor guarantees the accuracy of any of content posted on the service. By registering to use the service you agree to:
    1. Only vote in accordance with the number of votes permitted daily from a single computer. Not to use automated, commercial, or multivote means to increase votes for your photo(s). SCB-TO reserves the right to remove, and disqualify any Entries suspected of dishonest voting practices;
    2. Only use promotional codes and pricing available through the Service for photographic printing for the purposes of the Contest. Personal or commercial use of these codes is prohibited;
    3. Not to alter or modify any part of the Service, make no use that would interfere with or disrupt the Service or servers or networks connected to the Service, make no content available (whether through upload, post, email, transmit, or otherwise) that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  8. Winner selection: Contest winners will selected by the Contest judges based on the judging criteria and rules of the Contest. The decision of the judges shall be final. One (1) prize will be reserved for the 'People's Choice' award, which will awarded to the Entry with the most votes on the Contest website. Participants are eligible for a single prize, if a participant is selected for multiple awards, they will recieve the highest valued item and the participant with next highest ranked image will recieve the lesser prize. SCB-TO will not communicate with participants about the results of the photo contest.
  9. Notification of award: Participants selected as winners will be contacted by phone or e-mail (using the contact information provided by Participant at time of entering the Contest) at least three (3) times within the seven (7) days after the announcement of the winners. If the selected Participant cannot be contacted in that time, the Participant with next highest ranked Entry will be selected and the initial selected Participant will be disqualified and will have no recourse towards SCB-TO or anyone involved in the Contest. Prizes must be picked up in person, by the participant with valid photo identification, at the Award Ceremony held on May 30, 2014. Should the Participant be unable to attend the Award Ceremony, pick up must be arranged with the Contest organizing committee within fourteen (14) days of the Awards Ceremony or the Participant forfeits the prize. Prizes will not be mailed. Participants will be required to sign a Declaration and Release Form confirming compliance with the Contest Rules, acceptance of the Prize as awarded and releasing SCB-TO from all liability relating to the Contest. Selected Participants must also provide model releases and signatures for any individuals in the photo(s). No substitution for, replacement or transfer of the Prize, will be allowed.
  10. Prizes and approximate value (Canadian dollars): At the outset of the contest there are a total of twelve (12) prizes avalialable to be won. Odds of winning depend on the number of entries received. The prizes are as follows: Digital camera and lens package ($899), binoculars ($120), camera tripod ($140), camera bag ($164), Downtown Camera lens credit ($TBA), MEC two person tent ($280), two (2) Patagonia jackets ($150 each), tickets for two to Ripley's Aquarium of Canada ($60), cork iPad case ($45), one year Toronto Field Naturalists membership ($40), Bloor Hot Docs Cinema membership and tickets for two ($56). SCB-TO reserves the right to substitute prizes at greater or equal value should one of the prizes not be available for any reason.
  11. Third party products and services: SCB-TO assumes no responsibility for the quality, accuracy, timeliness, reliability or any other aspect of these products and services. If you make a purchase from a third-party website that you have accessed via a link on the Service, the information that you give as part of the transaction, such as your contact information and order number, may be collected by both the merchant and SCB-TO. A merchant may have privacy and data collection practices that are different from SCB-TO. SCB-TO has no responsibility or liability for these independent policies. You release SCB-TO and its affiliates from any damages or loss that you incur, and agree not to assert any claims against SCB-TO or any of its affiliates, arising from your interactions with, or purchase of any products or services made available by third parties through the Service. You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Service.
  12. Liability: SCB-TO does not assume any responsibility for lost, incomplete, late or misdirected entries or for any failure of the Contest website during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person's or any other person's participation or attempted participation in the Contest. Your use and browsing of the Service is at your risk, SCB-TO makes no warranty that the site or any of its functions will be uninterrupted or error-free, that defects will be corrected, or that any part of this site, including the servers that make it available, are free of viruses or other harmful components.

    Under no circumstances, including, but not limited to, negligence, will SCB-TO, or our parent organization, affiliates, contractors, volunteers, agents, assigns, executors, service providers, and/or licensors be liable for any direct, indirect, incidental, special or consequential claims, actions, damages or demands that result from the use of, or the inability to use, this site, including its materials, products, or services, or third-party materials, products, or services made available through the Service, even if we are advised beforehand of the possibility of such damages. You specifically acknowledge and agree that SCB-TO is not liable for any defamatory, offensive or illegal conduct of any user.

  13. Indemnification: You agree to indemnify, defend, and hold harmless SCB-TO; its affiliates and partners; and their respective officers, directors, employees, volunteers, agents, assigns, executors, members, licensors, representatives, and third party providers to the Service from and against all losses, expenses, damages, and costs, including attorneys' fees, resulting from any violation of these Terms. SCB-TO reserves the right to assume, at its sole expense, the exclusive defense and control of any matter subject to indemnification by you, in which event you will fully cooperate with SCB-TO.

    You must provide and are solely responsible for all hardware and/or software necessary to access the Service. You assume the entire cost of and responsibility for any damage to, and all necessary maintenance, repair or correction of, that hardware and/or software.

  14. Participants acknowledge they have read and understood the rules and regulations. Rules and regulations are subject to change any time without prior notice. Your continued access or use of the Service after such changes indicates your acceptance of the terms as modified. If you are dissatisfied with any aspect of the Service or with these rules and regulations, your sole and exclusive remedy is to discontinue accessing and using the Service.

    Participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these rules and regulations, participant’s rights and obligations, or the rights and obligations of the organizer in connection with the Contest, shall be governed by, and construed in accordance with the laws of Ontario, Canada.
